This research aims, first of all, to establish that Abû Hanîfa's (d. 150/767) positive view on the issue of performing wudû’ with nabîdh of date is correct, and then to reveal Abû Hanîfa's dalîls on this subject. The issue of wudû’ with nabîdh of date is controversial among early Hanafî jurists, and the jurist who expressed a positive opinion on this issue is Abû Hanîfa, the founding imam of the madhhab. The opinion that wudû’ can be performed with nabîdh of (...) date is the strong opinion of Abû Hanîfa mentioned in zâhir al-riwâya. The riwâya reported by Nûh bin Abi Maryam (d. 173/789) stating that Abû Hanîfa reneged on this view is not strong enough to oppose the view in zâhir al-riwâya. For this reason, it is not a correct approach to ignore the view in zâhir al-riwâya based on this riwâya. As a matter of fact, Abû Hanîfa's view of zâhir al-riwâya is conveyed in many of the classical Hanafî texts such as Mukhtasar al-Karkhi and Mukhtasar al-Tahâwî. Although the majority of Hanafî jurists preferred the view of Abû Yûsuf (d. 182/798), a significant group of Hanafî jurists such as Jassâs (d. 370/981), Kâshânî (d. 587/1191) and ‘Aynî (d. 855/1451) He supports Abû Hanîfa's view. Therefore, there are two views on the issue in Hanafî fıqh. In the literature, the dalîls of Abû Hanîfa's view is not available as a whole in a single source, but is scattered in many Hanafî fiqh sources. The Hanafî jurist Jassâs is the one who deals with the mentioned dalîls in the most comprehensive way in his many works. For this reason, the subject was examined by focusing on Jassâs's dalîls. Jassâs' istidlâls regarding the issue of wudû’ with nabîdh of date also mean defending Abû Hanîfa against other Hanafî jurists such as Abu Yusuf and Imâm Muhammad (d. 189/805). Jassâs' insistent attitude on this issue and his passionate counter-answers prove how much he deserves the title of defense. For the relevant determination, Hanafî fiqh classics are centered. Because the jurists who argue that wudû’ can be made with the nabîdh of date are among the Hanafî jurists. Then, the positive and negative approaches of the jurists about the nabîdh of date are given. Starting from the early Hanafî jurists, the views of the sahâbîs, the tâbi'ûn and many later jurists on the subject are included. The approach of the four madhhabs of fiqh is also examined in this section. Then, the istidlâls of Jassâs, which is the main subject of the research, were emphasized. It is seen that Jassâs' istidlâls have three main pillars: âya, hadîth and idjma. As a âya, the 6th âya of the sûra of Mâida, as a hadîth, the hadîth of ‘Abd Allâh bin Mas'ûd (r.a.) and as a idjma, the the sahâbîs idjma tries to showas references. The most controversial dalîl is undoubtedly the hadiths of Ibn Mas'ud (r.a.). Jassâs opposes those who claim that the hadîth is da‘îf and discusses the hadîth with its detailed tarîks and argues that this hadîth is sahîh. (shrink)

Qurʾān was revealed to the Prophet Muḥammad (pbuh) not as a written document, but by word of mouth over a period of approximately 23 years. He dictated the verses to the scribes of revelation. After this, Abū Bakr compiled the written verses; i.e. gathered between two covers. Thus when the Qurʾān was compiled as a text, a number of addresses lost their characteristics. This situation, which is a result of the shortcomings in inscription, suggested the necessity of separating the verses, (...) preserving the recitation method (waqf places) learned from Prophet and transmitting the Qurʾān towards new learners. As a result, the science of al-Waqf and al-Ibtidāʾ has emerged. The systematics of al-Sajāwandī was chosen among the people who systematized the waqfs marks and the mushafs that we have today are arranged according to the systematics of al-Sajāwandī. At this point, the issue of showing other addressing features of the Qurʾān, such as the emphasis, in text appeared as an area that to be considered. The aim of this study is to analyze this issue and to focus on the possibility and method of realizing the subject. If punctuation marks are to be added to the Qurʾānic text, this should be done by taking into account the characteristics of punctuation marks in Arabic. According to comparison between punctuation and wakf marks, it was seen that they have different characteristics. First difference is the systematic difference. Punctuation marks in modern Arabic script are divided into four groups: end marks, tone marks, quotation marks, and the signs used in mathematics. However, al-sajawānds consists of only end/stop marks. In this case, al-sajawānds do not function as punctuation marks indicating tone of voice/emphasis and quotations. The second difference is that punctuation marks are more about the meaning than waqf marks. Because waqf marks do not oblige reader to understand only one of the possible meanings. However, punctuation marks limit or even determine the meanings. In addition, waqf marks are also based on the recitation(s) of the Prophet/al-qirāʾat al-manqulah. Correct comprehension depends on correct reading. For correct reading, addressable features must be able to be incorporated into the text as much as possible. Today’s muṣḥaf, cannot show emotions, emphasis to the reader. Beside, each of the characteristics of waqf marks (al-waqf al-muʿānaqah ext.) cannot meet the end marks found in today’s punctuation marks. In this case, we can add emphasis marks to text in order to reflect the emphasis that are missing from them by keeping al-sajāwands. Likewise, the question of to where/whom the word belongs to, which may cause confusion in text, can be resolved with quotation marks. Hereby, it has been concluded that a pseudonym system that can reflect the emphasis features of the Qurʾān and show quotations, should be developed in addition to al-sajāwands. So, our proposal includes the following steps: keeping al-sajāwands existing in the muṣḥaf; placing the emphasis marks in today's punctuation marks, which will serve this function in places where the emphasis and tone of prayer’s voice cannot be reflected in writing; putting quotation marks. Thus, it will be possible to develop a system that can show the linguistic, grammatical, semantic, phonetic, emotional and reciprocity dimensions of address in the writing/text. In this context, the punctuation marks that we find useful to be added to the muṣḥaf are emphasis marks (:!؟) and some quotation marks («»: -). قَالَ فَمَنْ رَبُّكُمَا يَا مُوسٰى؟ قَالَ رَبُّنَا الَّذ۪ٓي اَعْطٰى كُلَّ شَيْءٍ خَلْقَهُ ثُمَّ هَدٰى. Tāhā 20/49-50 As an example, in this verse, there is a real question that is expected to be answered. Then a question mark can be put at the end of this sentence. In addition, a dot mark can be placed at the end of the answer sentence to indicate that the answer is concluded. (shrink)

Comprehending the messages of Qurʾān in terms of the relationship between occasions (sīra) and revelation has a profound influence on determining the contextual purpose and shades of meanings. Establishing such relationship necessitates dating sūras and verses. Although there are some oral transmissions (riwāya) that verses 12, 45, 47 and 77 were revealed in Madīnah, and some weak transmissions date this sūra as Medinan, this sūra is unanimously regarded as Meccan. Like many Meccan verses, not only the order of revelation and (...) causality of verses but also the content of the script do not provide concrete evidence about whether the whole sūra was sent down at once or revealed piece by piece or the date of the revelation. In this regard, in studies carried out on the dating of Sūrat Yāsīn, the dating of this sūra is established on the basis of the dates of the sūras coming before or after Yāsīn since they apparently have more definite datings. In recent studies done on the nuzūl order, Sūrat Yāsīn is dated on the basis of a time frame before the emigration to Abyssinia (615-616) in terms of Sūrat Maryam and Ṭāhā, or Muhammed’s return from Ṭāif and his Ascension (Isrāʾ) (620) in terms of Sūrat al-Jinn. The dating of the sūra covers a time span of 4 to 5 years and points out two discrete occasions of revelation. With this reason, there is a need for further studies to be carried out on dating Qurʾānic sūras, especially within the specific context of Sūrat Yāsīn. Traditional Islamic studies dispute the chronological order of the sūra, offering various chronological orderings for the sūra: 31, 36, 37, 39, 40 and 41. In the first part of this study, such variations and their causes are tentatively established and determining the precise chronology and listing of the sūra was attempted. Based on the analysis of the variations in the disputed ordering of the sūra, it has been found to be caused by five different reasons. When such discrepancies are accounted for and conflicts are resolved, the conclusion was reached that in almost all riwāyas, sūrat Yāsīn can be dated as the 41st chapter (sūra). In the second part of the study, on the basis of the discourse analysis of the sūra, new arguments to date the chronology of the sūra were put forward. These are; a- Because of their obstinacy, unbelievers will not heed the warnings directed at them (36/11), b- The speeches of unbelievers should not grieve Prophet Muhammad (36/76), c- The use of the word Rahmān the Most Gracious (36/11, 15, 23, 52), d- In return for conveying the message of Allah, prophets do not ask people for any wage (36/21), e- Regarding Qurʾān as book of poetry and calling Muhammad a poet (36/69), f- The possibility of recreation and reviving bones (36/78). Such arguments presented in a – f usually refer to events happening in Mecca and in particular the second part or the end of Meccan period, yet there is no exact date. g- Based on the phrase “al-Fulq al-Mashhūn”, the fact that sūrat Yāsīn should be dated after the emigration to Abyssinia (615-616) presents strong evidence that it was revealed after sūrat Maryam, though this is still not enough to give an exact date. h- In sūrat Yāsīn, in phenomenon of (a man coming from the farthest part of the City) (36/20), two names (Hazrat Abū Bakr and el-Hāris b. Abī Hāla) and two dates (month of Dhu al-Qiʿdah/April 5 – May 4, 615 and three days after Shawwal 15/February 27, 617) are mentioned in Sīra for the purpose of consolation and encouragement. In the third part of the study, in the chronological ordering of sūrat Yāsīn, information regarding the dating of sūras coming before and after Yāsīn are evaluated based on their similarity with Yāsīn in terms of discourse and diction. In nuzūl orderings, when riwāyas regarding dating sūrat al-Qamar, Ṣād and al-Jinn coming before Maryam and Ṭāhā are analysed, events happening during 7th or 10th year after emigration were observed. In addition, there were close connections between the discourse and diction of Yāsīn with those of Ḥavāmīm sūras. This brings to the mind the possibility that some sūras might be listed in the wrong place because of the vagueness of the piecemeal character of the Qurʾānic revelation and its effects on riwāyas. Based upon the findings and inferences in the first three sections of this study, sūrat Yāsīn was determined to be the 41st chapter (sūra) of Qurʾān. The dating of sūrat Yāsīn presented some difficulties especially while trying to date it according to the interrupted revelation order approach, and considering it together with Sūrat Maryam and Ṭāhā. However, listing sūrat Yāsīn on the basis of uninterrupted revelation order along with Sūrat al-Jinn, the previous sūra and Ḥāmīm sūras is found to be a more coherent strategy since it gives priority to the succession of two sūras. This is the first complete English translation of the Jami al-hikmatayn, written in Persian, the final, and crowning, work of the great poet, philosopher, and Ismaili missionary Nasir-i Khusraw (1004-1077). Twin Wisdoms Reconciled was written at the request of the emir of Badakhshan 'Abu al-Ma'ali 'Ali ibn Asad' who was perplexed by the questions in a long philosophical ode written a century earlier by Abu al-Haytham Jurjani, an obscure Ismaili author. The ode consists of a series of some 90 questions (...) on a wide range of subjects, from logic and metaphysics to medicine, cosmology, and physics, as well as esoteric Ismaili doctrine. Nasir-i Khusraw's text takes the form of a commentary on certain astutely selected lines. Twin Wisdoms Reconciled represents yet another example of the author's lifelong endeavour to transform Persian philosophical prose into a deft and nuanced instrument of expression. The work has not been as extensively studied as Nasir-i Khusraw's other major theological and philosophical treatises, all written in his final exile in Badakhshan, in part perhaps because of its textual difficulties. Twin Wisdoms Reconciled survives in a single manuscript of dubious accuracy in the Aya Sofya collection, Suleymaniyye Library, Istanbul. The present translation is based on the critical edition of the text produced by Henry Corbin and Mohammed Mo'in in 1953, but with frequent reference to the unique original manuscript. Twin Wisdoms Reconciled represents an endeavour to reconcile two apparently opposed forms of knowledge: the knowledge accorded by revelation and exegesis and the knowledge gained by reason. Seeing that "the bazaar of wisdom" stands empty because of the mutual incomprehension of traditional theologians and Aristotelian philosophers, Nasir-i Khusraw stepped boldly forward to reinvigorate that desolate marketplace. His final work, written in 1070, is thus a testimony as well as an exposition of his mature thought. (shrink)

This essay reviews the place and role of Public Service Media (PSM) in promoting social justice in the changing digital media landscape through the ethos of diversity. Media diversity – the value and practice of including varied viewpoints, social groups, voices, and channels or outlets in media – has long been a declared pillar of PSM organizations worldwide. However, current changes in the digital media landscape and the growing extension of PSM organizations to digital platforms require re-reading the premise of (...) promoting media diversity as a tool for social justice. This essay identifies a paradox. On one hand, online media appear to accommodate a greater range of diverse voices and players, particularly in the PSM ecosystem. At the same time, these very same online spaces jeopardize diversity, as the increasing practices of personalization, algorithmic curation, and platformization often reduce diversity of representations, voices, and exposure to content, thereby hindering opportunities for social justice and equality. This essay shines a spotlight on this nexus of conflicting mechanisms. The essay begins with in-depth definitions of the two somewhat convoluted terms diversity and social justice. This section includes a review of global perspectives on PSM organizations, and the long-standing value of diversity promoted through them for decades. We then review the impact and changes identified in PSM platforms worldwide in light of the digital turn in the media field. This is followed by an in-depth discussion of the inherent tension between mechanisms that promote and hinder diversity online. Throughout this discussion, we raise questions about the practical dimensions of using online media to promote social justice through diversity. It provides a useful starting point for considering the intersection of Public Service Media, online platforms, diversity, and social justice. Thus, the essay will serve academic scholars studying social justice on a conceptual level as well as practitioners and stakeholders in the media industry at large, and PSM in particular, seeking to practically promote social justice. In the Sophist, Plato presents the possibility of the separation of things in relation to each other based on the communion (koinōnia) of logos. In this study, I discuss the linguistic communion revealed in the dialogue by illuminating its three fundamental aspects: (1) Articulation of letters in names as communion on the syntactic level, (2) Predication of names in logoi as communion on the semantic level, (3) Homologoi of logoi as the ultimate communion of language. In recent decades there has been a significant increase in community rehabilitation programs for people with mental health conditions. One such nationwide programs is Amitim in Israel whose mission is to foster the psychosocial rehabilitation of people with mental health conditions in the community. Amitim’s flagship program consists of arts-based groups that integrate participants with mental health conditions and non-clinical community members. To better understand the experiences of participants in these arts-based groups, five focus groups were conducted with participants from (...) 15 integrated arts-based groups. In total, 17 people with mental health conditions and 21 non-clinical community members were interviewed for this qualitative study. Three main themes emerged from the thematic analysis: creation and expression through the arts promote well-being, self-disclosure in a safe space encourages a sense of belonging, and “we are all in the same boat.” The participants underscored the role of creation and expression through the arts in facilitating emotional expression, self-discovery, interpersonal communication, and spiritual elevation. The findings suggest that the facilitators should instill a sense of equality by enabling intergroup acquaintances without labeling participants’ mental health status. Integrated arts-based groups should be accompanied by a mental health professional who can contain and work through complex emotional situations when needed. Arts therapists who specialize in both arts and mental health are particularly suitable for this role. Overall, the interviewees reported that participation in the integrated arts-based groups positively impacted their personal recovery processes by providing a corrective experience of equality as well as enhancing a sense of belonging to the community and social relationships. The participants also reported being empowered by the final artistic event that not only enhanced their sense of visibility, competence, and aspirations for future development in personal, interpersonal, and artistic realms, but also helped to combat both self- and public stigma. Sexes are normally taken to be fundamental categories in biology – many sexually reproducing organisms fall under the categories of female/male. Much research aims at explaining differences between sexes. Sexual selection forms a central framework for explaining “typical” distributions of traits among sexes, and explicating circumstances leading to “reversal”. I claim sexual selection models needn’t make use of sexes, that sexes lack explanatory significance in such models. I offer a framework of reproductive dimorphism and argue it’s better than that of (...) sexes, because it (i) is more compatible with explanations of sexual selection and (ii) allows for their greater applicability. This paper will discuss the correlation between the world of everyday life, finite provinces of meaning, and religion. To this end, the paper will start out by explaining Schutz’ considerations on “paramount reality” of the world of everyday life as well as the theory of “multiple realities” and “finite provinces of meaning”. Schutz’ considerations will then be elaborated upon and taken a step further in a discussion of the various ‘realnesses’ of the multiple realities. Special attention will be paid to (...) a finite province of meaning only mentioned in passing by Schutz: religion. The paper will first analyze the special features of religion as a finite province of meaning and highlight the correlation it enters with the world of everyday life. Subsequently, hereafter and paradise conceptions will be described as “ultimate provinces of meaning,” and it will be shown how their realnesses connect to the world of everyday life. Finally, the “fundamental anxiety” will be studied as the motor of the relevance structures of the world of everyday life, the finite provinces of meaning as well as the hereafter conceptions. In many countries, prenatal testing for certain fetal abnormalities is offered via publicly funded screening programs. The concept of reproductive autonomy is regarded as providing a justificatory basis for many such programs. The purpose of this study is to re‐examine the normative basis of public prenatal screening for fetal abnormalities by changing our perspective from that of autonomy to obligation. After clarifying the understanding of autonomy adopted in the justification for public prenatal screening programs, we identify two problems concerning this (...) justification: first, the extent to which the government is obliged to meet this demand is not evident; and, second, it is not clear whether the provision of public screening is the most appropriate way to promote autonomy. Next, to tackle these problems, we focus on Onora O’Neill’s argument of rights and obligations. Drawing on this argument, we show that, in addressing the problems above, it is important to change our normative perspective from rights or autonomy to obligation. Our argument will show that since the government does not have an incontrovertibly fundamental obligation to promote autonomy, this obligation needs to be constrained in terms of compatibility with other fundamental obligations. In addition, even if a government is obliged to promote autonomy to some degree, there could be more appropriate means to achieve it than providing public prenatal screening; therefore, it is not necessary for government obligations to extend to the provision of public prenatal screening. L’objectif de cet article est de réfléchir à la conjonction de la littérature et de la politique chez Beauvoir en comparant sa trajectoire avec celles d’autres écrivaines de son temps afin d’en montrer le caractère exceptionnel.

Following the eclectic itineraries of ‘Near East’ expert, R. M. Graves, this article tells a story of an ongoing Nakba (catastrophe) of small and large legal decisions. Without reducing the human catastrophe of the event of the Nakba (the 1948 Palestinian forced exodus), it engages with it as a legal event that crosses (in this story at least) from Cairo to Jerusalem, from the League of Nations’ era (1920–1946) to the United Nations’ era (1945–), from the governance of labour and (...) gender, to labour partition, and finally to the governance of municipalities through law and expertise. Graves’ relationship to both Cairo and Jerusalem was materialized through different forms of affective legal governance. Graves, who in his own dichotomous words was ‘neither a Zionist nor an anti-Semite’, managed Jerusalem across national lines in the wake of the UN Partition Plan (1947), and as the old empire was withdrawing right before Jerusalem itself became a site of the catastrophe—right before the Nakba. This article discusses the status of transcripts in Conversation Analysis. Repeatedly, the function and the epistemic state of transcripts have been the subject of discussions and reflections in Conversation Analysis. Drawing on a range of empirical examples taken from various authors, this article discusses the question of how present forms of visuality and multi-modality in the data material or the handling of artifacts can be captured in transcripts and how the problem of ‘representation’ of complex and interactive situations can be (...) solved. It turns out that the evolution of recording media along with the medium shift in Conversation Analysis has altered the status of transcripts, effecting a twofold ‘in-between-ness’: transcripts inhabit the conceptual space between orality and literacy on the one hand and between artwork and figure on the other hand. This oscillating hybrid nature proves to be the central property of transcripts in present-day Conversation Analysis. Transcripts are described as scientific ‘objects of knowledge’ and discussed with respect to their methodological and epistemic status. (shrink)

The current study investigates Arabic orientational metaphors in Modern Standard Arabic. Specifically, it is a corpus-based study that tries to retrieve conceptual orientational metaphors ofup-down, front-back, right-left, andcentral-peripheralspatial orientation. The study assumes that every orientation can be described using a set of different lexemes, and these lexemes express different linguistic orientational metaphors with different levels of usage frequency. It is hypothesized that studying the relationships between these lexemes, their etymologies, and frequency can provide a detailed, integrative account of metaphorical aspects (...) and conceptual systems related to each spatial orientation. A bottom-up methodology to identify metaphorical usages of spatial lexemes was applied to theStanford Arabic Corpus. The results list the spatial linguistic metaphors comprising conceptual metaphors and show for each orientation that mapping orientations onto conceptual metaphors is a complicated process, which integrates linguistic and cognitive levels. The cognitive-perceptual and cultural implications of these findings are discussed. (shrink)

The present study delves into the complex interplay between religion and secularism within the framework of contemporary European democracies. It explores how secularism is changing and how it is affecting public life, societal norms, and government. The purpose of the study is to clarify the difficulties and controversies surrounding secularism in Europe by examining the historical context and current dynamics. For measuring, the research used Smart PLS software and generated results, including descriptive statistics, which also present a smart PLS Algorithm (...) model between them. The discussion is on how secularism is interpreted and applied differently in different European nations, emphasizing the conflicts between the principles of religious freedom and governmental neutrality. The paper shall try to decide whether its functions suggested in the first Critique and its performance in the third Critique are contradictory or developmental with respect to Kant's critical philosophy. Desde la primera Crítica y hasta la tercera, la imaginación recibe diferentes calificativos, tales como imaginación reproductiva, productiva o trascendental. El trabajo intenta determinar si las funciones de la imaginación sugeridas en la primera Crítica y su papel en la tercera Crítica son contradictorias o si implican más bien un desarrollo respecto de la filosofía crítica de Kant. The semiotic model that disregards the normative context represented by the protagonist examines how we can distinguish the three conceptions of heroism, namely hero, semi-hero, and anti-hero. What are the methodological criteria whereby we can follow the protagonist in the text from beginning to end? To answer them, this article tries to present a model made up of five stages/criteria which constitute a semiotic model by means of which the connection to heroism can be determined. These are: (1) motivation, (2) (...) will, (3) ability, (4) execution, and (5) outcome. These stages can be logically classified into three categories: 1) Pre-action (the first three stages), 2) Action (the fourth stage), 3) Post-action (the fifth stage). This paper attempts to bring new insights to a long-standing historical debate over medical specialization by analyzing the formation of medical mycology, a somewhat marginal biomedical discipline that emerged in the mid-twentieth century around studies of fungal disease in humans. The study of fungi predates that of bacteria and viruses, but from the 1880s it became eclipsed by bacteriology. However, in the postwar period, there were moves to establish medical mycology as an independent speciality. I trace the processes that led (...) to the launch of professional societies in the United States, Britain and Japan, three major players in medical mycology, and more broadly in biomedicine. The analysis of the three different national contexts illustrates how geographical, medico-technological, epidemiological, political and social conditions gave the specialty a distinctive character in each country; this was further complicated by the different and changing medical fields in which fungal diseases were studied and treated. The three case studies show medical specialization as a process that is not simply cumulative but responds to specific historical events and developments. (shrink)

Executive functions measures of 27 asthmatic children, with general learning difficulties, were tested by using the Wisconsin card sorting test (WCST), and were compared to the performances of 30 non-asthmatic children with general learning difficulties. The results revealed that the asthmatic group has poor performance through all the WCST psychometric parameters and especially the perseverative errors one. The results were discussed in light of the postulation that poor executive functions could be associated with the learning difficulties of asthmatic children. This study aimed to examine whether social support promotes identity meaning among older adults. We hypothesized that when two spouses exchange social support, their sense of marital identity is enhanced. Among older adults, parental identity may be more strongly enhanced when parents provide social support to their children rather than receive social support from them. We conducted a longitudinal survey of 355 older adults, who were assessed four times over 2 years. First, we confirmed the relationship between social support and (...) identity meaning using an autoregressive path model. Second, we examined the effect of social support on the trajectory of role identities in a growth curve model. The intercepts of receiving support and providing support were significantly associated with the intercept of marital identity. In addition, the intercept of identity meaning for parents correlated with the intercept of providing support to their children but not with that of receiving support from their children. Social support between family members promotes role identities in family relationships. In particular, providing support to children correlates with parental roles which connect to subjective well-being. (shrink)
